Introduction: Kepala Soa is an essential element of the customary institutional structure, holding a strategic position in representing the kinship group (soa) and bridging the relationship between the indigenous community and the village (negeri) government.
Purpose of the Research: This study analyses the existence of Kepala Soa within the village governance system under Central Maluku Regency Regional Regulation No. 1 of 2006, focusing on the normative arrangement of its position and authority and its relevance in customary governance practice in Central Maluku.
Methods of the Research: This is normative legal research employing statutory and conceptual approaches through a literature study of primary and secondary legal materials related to customary governance and indigenous legal communities.
Results / Findings: Regional Regulation No. 1 of 2006 grants legal legitimacy to Kepala Soa as part of the Saniri Negeri, with representative, participatory, and supervisory functions. In practice, however, challenges remain in harmonising customary law with modern governmental administration. The existence of Kepala Soa remains relevant in maintaining the balance of the village governance structure and preserving customary values as the identity of the indigenous legal community.
